These Terms & Conditions (“Terms”) govern your access to and use of the Mind Your Higher Ground website, content, and any related services linked to these Terms (collectively, the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
2) Changes to These Terms
We may update these Terms from time to time. The updated Terms are effective once posted. Your continued use of the Site after changes are posted means you accept the updated Terms.
3) Eligibility
You must be at least 18 years old to use the Site and purchase offerings. By using the Site, you represent that you are legally able to enter into this agreement.
4) Use of the Site
You agree to use the Site for lawful purposes only. You may not: • Violate any applicable law or regulation • Attempt to gain unauthorized access to the Site or its systems • Introduce malware (viruses, spyware, worms, etc.) • Scrape, crawl, data mine, harvest, or automate access without our written permission • Interfere with Site operations or security • Use the Site to harass, threaten, or harm others • We may suspend or terminate access for violations.
5) Purchases, Subscriptions, and Billing
Some offerings may be available for purchase through the Site (including recurring subscriptions). Recurring billing: If you enroll in a subscription, you authorize us (or our payment processor) to charge your payment method on a recurring basis until you cancel. Cancellation: You are responsible for canceling before the next billing date to avoid future charges. Cancellation stops future billing; it does not retroactively refund prior charges unless required by law or explicitly stated. Price changes: We may adjust pricing from time to time. If your subscription price changes, we will provide notice where required. Payment processors: Payments may be handled by third-party processors. Their terms and privacy policies apply to payment processing.
6) Refunds
Refund terms are governed by our Refund Policy, which is incorporated into these Terms by reference. If there is a conflict between these Terms and the Refund Policy, the Refund Policy controls for refund-related matters.
Mind Your Higher Ground provides coaching, education, and wellness-oriented programming. We are not providing medical care, mental health treatment, diagnosis, or therapy through the Site.
Nothing on the Site is medical, psychological, legal, or financial advice. If you need such advice, consult a qualified professional. If you are in crisis or may be a danger to yourself or others, seek immediate professional help or emergency services.
8) Community Spaces + Confidentiality + Conduct
Certain offerings include access to community spaces (including private digital platforms, apps, or groups). Community standards: You agree to uphold confidentiality, respect, and a zero-tolerance standard for harassment, hate speech, threats, doxxing, or “mean girl” behavior. No solicitation: You may not promote or sell services, recruit clients, or solicit members unless you have explicit written permission. Confidentiality: You agree not to share other members’ personal information, stories, or identifying details outside the community. Enforcement: We may remove content, suspend access, or terminate membership for violations, without refund except where required by law.
9) Protected Entry and Screening (If Applicable)
Some offerings may require screening or an application. We reserve the right to accept, waitlist, decline, or remove access to protect community integrity, safety, and fit. Decisions are final.
10) Intellectual Property + Limited License
Unless otherwise stated, we own (or license) all Site content and materials, including but not limited to: text, graphics, branding, logos, program names, frameworks, worksheets, slide content, course materials, audio/video, and downloadable resources (“Content”).
You are granted a limited, personal, non-transferable, non-commercial license to view and use the Content for your personal use only.
You may not: • Copy, reproduce, distribute, or share Content publicly • Republish Content online or in trainings/programs • Create derivative works based on Content • Sell, license, or exploit Content for commercial purposes
11) Trademarks
“Mind Your Higher Ground,” associated names, logos, marks, and program titles may be trademarks of Mind Your Higher Ground LLC. You may not use our trademarks without written permission.
12) Third-Party Links and Platforms
The Site may link to third-party websites or tools. We are not responsible for third-party content, availability, or practices. Your use of third-party sites is at your own risk and subject to their terms.
13) No Warranties
The Site and Content are provided “as is” and “as available.” We do not guarantee that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that information will always be complete or current.
14) Limitation of Liability
To the fullest extent permitted by law, Mind Your Higher Ground LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising from or related to your use of the Site or Content.
In any event, our total liability for claims relating to the Site will not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim (or $100 if you have not made a purchase), unless applicable law requires otherwise.
15) Indemnification
You agree to indemnify and hold harmless Mind Your Higher Ground LLC from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising out of your breach of these Terms, misuse of the Site, or violation of any law or third-party rights.
16) Termination
We may suspend or terminate your access to the Site at any time if we believe you have violated these Terms or created risk to the community or business. Sections relating to intellectual property, disclaimers, limitation of liability, and indemnification survive termination.
17) Governing Law and Venue
These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles. Any dispute will be brought in the state or federal courts located in Indiana, and you consent to that jurisdiction and venue.
18) Severability
If any provision of these Terms is found unlawful or unenforceable, the remainder will remain in effect.
19) Entire Agreement
These Terms, together with any referenced policies (including the Refund Policy and Privacy Policy), form the entire agreement between you and Mind Your Higher Ground LLC regarding the Site.
